• Your inputs may be processed through third-party AI services (such as OpenAI) to provide our services
• AI-generated outputs are recommendations only and should be independently verified
• We use industry-standard AI providers that do not use API submissions for model training

2.2 Voice Recording Feature

When you use our voice recording feature to provide information:

• You grant us permission to record, process, and transcribe your voice
• You confirm that you have the right to provide any information shared in voice recordings
• Voice recordings are processed for transcription purposes only and then deleted
• Transcribed text becomes part of your inquiry data and is subject to our Privacy Policy
• You may choose to type your responses instead of using voice recording at any time

3. User Responsibilities

3.1 Account and Information Accuracy

You agree to:

• Provide accurate, current, and complete information
• Maintain the security of any account credentials
• Notify us immediately of any unauthorized use of your account

4. Intellectual Property Rights

5. Service Engagement and Deliverables

Specific services will be detailed in a separate proposal or statement of work ("SOW") that outlines scope, deliverables, timelines, and pricing. The SOW, along with these Terms, constitutes the entire agreement between you and AI Plumbing for the services described.

5.2 AI-Generated Content

Our services include AI-generated reports, recommendations, and analysis created using large language models (LLMs). You acknowledge and agree that:

• AI-generated content is provided "as is" for informational purposes only
• AI outputs may contain errors, inaccuracies, or incomplete information
• All AI-generated recommendations should be independently verified by qualified professionals before implementation
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content for your specific use case
• You are solely responsible for any decisions made based on AI-generated recommendations

5.3 No AI Training on Your Data

We use third-party AI services (such as OpenAI) that have policies prohibiting the use of API data for training their models. Your data submitted through our platform is not used to train or improve third-party AI models.

6. Fees and Payment

6.1 Pricing

Fees for our services will be specified in the applicable SOW or proposal. All fees are in U.S. dollars unless otherwise specified.

6.2 Payment Terms

Payment terms will be outlined in the SOW. Unless otherwise agreed, invoices are due within 30 days of the invoice date. Late payments may incur interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

6.3 Refunds

Refund policies, if applicable, will be specified in the SOW. In the absence of a specific refund policy, all fees are non-refundable once services have commenced.

7. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of our engagement. This obligation survives the termination of our services.

Confidential information does not include information that: (a) is or becomes publicly available through no breach of this agreement; (b) was rightfully known prior to disclosure; (c) is independently developed; or (d) is required to be disclosed by law.

8. Data Privacy and Security

We are committed to protecting your data. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

While we implement industry-standard security measures, you acknowledge that no system is completely secure, and we cannot guarantee the absolute security of your data.

9. Disclaimers and Limitations of Liability

9.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. Specifically regarding AI-powered features:

• AI-generated content may contain errors, inaccuracies, or hallucinations
• Voice transcription may not be 100% accurate
• LLM outputs are probabilistic and may vary between uses
• All AI-generated recommendations must be independently verified before implementation
• We make no warranties regarding the accuracy or reliability of AI-generated content

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI PLUMBING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Plumbing and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or any content you provide

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use our services will immediately cease
• You remain responsible for any outstanding fees
• Provisions that by their nature should survive termination shall survive, including confidentiality, intellectual property rights, disclaimers, and limitations of liability

In the event of any dispute, you agree to first contact us to attempt to resolve the dispute informally.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13.3 Arbitration

Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration shall take place in Delaware, and judgment on the arbitration award may be entered in any court having jurisdiction.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable SOW, constitute the entire agreement between you and AI Plumbing regarding our services.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
